Morgan Stanley is seeking an attorney with experience handling U.S. and international cybersecurity and privacy matters to join its Cyber & Privacy legal team. This attorney will provide support for a broad range of business units and functions at the firm. Familiarity with U.S. Federal consumer protection laws and regulations governing the financial industry-as well as privacy and cybersecurity laws in the E.U., Canada, Central America, and South America-is preferred but not required.
Primary Responsibilities
> Provide legal support and advice on cybersecurity, privacy, fraud and operational resilience matters impacting Morgan Stanley's Wealth Management (WM), Institutional Securities Group (ISG), and Investment Management (IM) divisions, as well as enterprise-level business functions such as Human Resources, Operational Risk, Central Privacy Compliance (CPC), Firmwide Marketing, Firmwide AI, and Cyber, Data, Risk & Resilience.
> Serve as a collaborative subject matter expert to other lawyers within the Legal and Compliance Division and provide advice to functional areas and regional business units on privacy and cybersecurity laws and requirements.
> Partner closely with lead cyber & privacy counsel for WM, ISG, and IM divisions, as well as international data protection counsel, to provide strategic direction to Morgan Stanley's business units and enterprise functions as they navigate complicated privacy and cybersecurity issues.
> Advise on requirements and restrictions on the collection, use, storage and sharing of sensitive client, consumer and employee information, including with respect to Morgan Stanley's use of artificial intelligence and machine learning technologies.
> Assist in the maintenance and improvement the Firm's cybersecurity and privacy law program, coordinating privacy, fraud, and cybersecurity legal requirements.
> Work cross-functionally with Morgan Stanley's CPC team and business unit-specific Risk Management teams to support maintenance notices, policies and procedures for privacy and information security, consistent with applicable international, federal and state laws, rules and guidance.
> Partner with Morgan Stanley's CPC Privacy Operations team to advise on Privacy Impact Assessments and data subject access rights requests.
> Participate in projects addressing Morgan Stanley's continued utilization of and leadership in artificial intelligence and machine learning.
> Maintain current knowledge of applicable state, federal and international cybersecurity, privacy, fraud and system resilience laws and regulations, and work with internal stakeholders, law enforcement, and regulators to respond to and remediate incidents.
> Maintain and disseminate monthly, enterprise-level communications to business, legal, risk, and compliance partners on emerging national and international trends and issues in cybersecurity and privacy law. Skills & Experience
> J.D. with a minimum of 8 to 10 years of experience, including experience in or with financial services firms.
> Knowledge of U.S. privacy and cybersecurity law, including but not limited to the Fair Credit Reporting Act (FCRA), Gramm-Leach-Bliley Act (GLBA), the California Consumer Privacy Act, CAN SPAM, TCPA, federal interagency guidance on information security and breach response programs, state breach notification statutes, and data security frameworks (e.g. NIST, PCI-DSS, NY DFS 500, etc.).
> Knowledge of cutting-edge information technology, web, mobile, and their privacy and data security implications with a strong interest in financial services technology.
> Experience with artificial intelligence technology and emerging artificial intelligence regulatory regimes in the U.S. and internationally.
> Admitted to practice in a U.S. state
> Ability to interact and effectively advise senior members of the Firm and its business units
> Strong problem-solving skills and ability to understand practical solutions to legal problems are a must
> Polished written and verbal communication skills; position requires executive presence as well as an ability to tailor messaging to audiences (senior and less senior, lawyers and non-legal professionals, etc.)
> Strong interpersonal skills and ability to work in a group or independent setting
> Proven track record of meeting deadlines, learning quickly, taking the initiative, working proactively, being resourceful and shouldering additional responsibility
> Willingness to be flexible and agile when shifting business priorities or external forces impact team coverage needs
> Ability to work collaboratively on a team, supporting and championing both individual and team success in helping the Firm meet its goals
> Ability to manage multiple tasks concurrently in an efficient and effective manner
> International Association of Privacy Professionals (IAPP) Certification (e.g. CIPP/US, CIPT, CIPM, AIGP) helpful, but not required

Expected base pay rates for the role will be between $110,000.00 and $190,000.00 per year at the commencement of employment. However, base pay if hired will be determined on an individualized basis and is only part of the total compensation package, which, depending on the position, may also include commission earnings, incentive compensation, discretionary bonuses, other short and long-term incentive packages, and other Morgan Stanley sponsored benefit programs.
